By their nature, employment cases often pivot on out-of-court statements. Classic examples include remarks like “You’re getting too old for this job.” But can such statements be admitted as evidence, or are they inadmissible hearsay? Reports of co-worker slurs, internal investigation notes, troubling texts, or comments from video conferences may all be challenged as hearsay.
