By their nature, employment cases often pivot on out-of-court statements. Classic examples include remarks like “You’re getting too old for this job.” But can such statements be admitted as evidence, or are they inadmissible hearsay? Reports of co-worker slurs, internal investigation notes, troubling texts, or comments from video conferences may all be challenged as hearsay. How do plaintiffs’ attorneys get such statements admitted — and how can defense counsel prevent it? What is a judge’s perspective on which statements must be considered?

This panel, featuring Hon. Stephen Charles Shannon (Fairfax County Circuit Court), Adam S. Nadelhaft, and Meredith Schramm-Strosser, will explore the contours of hearsay, relevant exceptions, and how courts generally rule on the types of out-of-court statements that frequently underpin employment cases.
